Black Therapy Network Privacy Policy

Black Therapy Network (“BTN,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how information is collected, used, disclosed, retained, and protected when you visit blacktherapy.net, create or use a BTN account, request a provider match, communicate with BTN, use marketplace features, or otherwise interact with our technology platform.

BTN operates a technology marketplace that facilitates connections between users and independent mental health professionals. BTN is not itself the healthcare professional providing diagnosis, psychotherapy, treatment, prescribing, or other clinical services. Independent providers are responsible for their own professional services and may have separate privacy notices that apply to information they collect in connection with clinical care.

1. Scope and Health-Information Context

This Privacy Policy applies to information BTN collects for its own marketplace and business purposes. Depending on the relationship and function involved, certain health information may be governed by HIPAA, state health-privacy laws, consumer-protection laws, or other privacy requirements. HIPAA does not automatically apply to every technology marketplace or every item of health-related information. When BTN performs a function on behalf of a HIPAA-covered provider that legally makes BTN a business associate, the applicable Business Associate Agreement and HIPAA requirements govern that function.

A provider’s clinical records, diagnosis, treatment notes, treatment plans, prescriptions, and other information created or maintained by the independent provider in the provider-patient relationship are governed by the provider’s own legal duties and privacy practices unless BTN expressly states otherwise.

2. Information We Collect

Contact and account information, such as name, email address, telephone number, login information, and account preferences.
Marketplace and matching information you choose to provide, such as service interests, therapist preferences, availability, location, scheduling needs, and information reasonably necessary to facilitate a requested connection.
Transaction and billing information. Payment card information may be collected and processed by third-party payment processors; BTN may receive transaction confirmations, billing status, and limited payment-related information.
Communications with BTN, including customer-support requests, contact-form submissions, emails, and SMS messages.
Technical information, such as IP address, browser type, device information, approximate location derived from IP, pages viewed, referral source, and cookie or similar technology data.
Provider marketplace information submitted by professionals, such as profile information, credentials, licensure information, professional background, availability, and service preferences.
Other information you voluntarily provide to BTN.

3. How We Use Information

Operate, maintain, secure, personalize, and improve the BTN platform.
Facilitate provider discovery, matching, scheduling, account support, and communications requested by users and providers.
Process or facilitate transactions, memberships, subscriptions, refunds, or payment-related support where applicable.
Respond to inquiries and provide customer service.
Send service, administrative, security, account, and consented communications.
Detect fraud, misuse, security incidents, and violations of our Terms of Service.
Comply with law, legal process, licensing-related obligations applicable to our marketplace functions, and enforce our agreements.
Analyze platform performance and improve user experience, subject to the privacy and tracking limitations described below.

4. How We Disclose Information

We may disclose information only as reasonably necessary for the purposes described in this Policy, including:

Independent providers: When you request a connection, match, booking, or other provider-related marketplace function, we may share information reasonably necessary to facilitate that request with the relevant provider.
Service providers and processors: We may use vendors for hosting, communications, customer support, analytics, security, payment processing, identity/account services, and other operational functions. They may process information only for authorized service purposes and subject to applicable contractual restrictions.
Legal, safety, and compliance: We may disclose information when reasonably necessary to comply with law, legal process, enforce rights, investigate fraud or security issues, protect users or others, or respond to a valid government request.
Business transactions: Information may be disclosed as part of a merger, financing, acquisition, reorganization, sale of assets, or similar transaction, subject to applicable law and appropriate protections.
With your direction or consent: We may disclose information when you direct us to do so or provide consent.

5. SMS / Text Messaging Privacy

If you voluntarily opt in to receive text messages from Black Therapy Network, we may use your mobile number to send recurring customer-care messages regarding your inquiry, intake process, scheduling, appointments, account, or service support. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent to receive text messages is not a condition of purchasing or receiving services.

Mobile Data Non-Sharing Notice

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. Service providers that support delivery or operation of BTN messaging may process information only as necessary to provide those services.

6. Cookies, Analytics, and Advertising Technologies

BTN may use cookies and similar technologies for essential site functions, preferences, security, measurement, and analytics. Where required by law, we will provide consent or privacy-choice controls for non-essential technologies.

BTN does not intend to disclose the contents of private intake or matching responses, provider communications, appointment details, or other sensitive health-related information to advertising platforms for their independent marketing or cross-context behavioral advertising. We configure our technology with the goal of limiting sensitive data exposure and expect service providers to use data only for authorized purposes.

You can use available cookie or privacy-choice controls, browser settings, and recognized legal rights to manage certain technologies. Disabling cookies may affect site functionality.

7. Sale, Sharing, and Targeted Advertising

BTN does not sell mobile numbers or SMS opt-in consent. BTN also does not sell the contents of private therapy-related intake or matching responses for monetary consideration. Depending on applicable state law, certain analytics or advertising activities may be treated as “sharing,” “targeted advertising,” or a similar regulated activity even when no money changes hands. Where applicable, BTN will provide legally required choices or opt-out mechanisms.

8. Security

BTN uses administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. No Internet transmission, platform, or storage system can be guaranteed to be completely secure. Users are responsible for protecting account credentials and should notify BTN promptly of suspected unauthorized account activity.

9. Data Retention

BTN retains information for as long as reasonably necessary to provide the platform, maintain business and transaction records, meet legal and security obligations, resolve disputes, enforce agreements, and support legitimate operational purposes. Retention periods may vary by information type, contractual obligation, and applicable law. Independent providers determine retention of their own clinical records under laws and professional requirements applicable to them.

10. Your Privacy Rights

Depending on where you live and the law that applies, you may have rights to request access, correction, deletion, portability, or information about certain uses or disclosures of personal information, and you may have rights to opt out of certain targeted advertising, sharing, or sales. Some information may be exempt from a request or retained where legally required. To submit a request, email support@blacktherapy.net with “Privacy Request” in the subject line. BTN may verify your identity before completing a request.

11. Children and Minors

The general BTN website is not directed to children under 13. BTN does not knowingly collect personal information directly from a child under 13 through the general platform without legally required authorization. If services involving a minor are available through a provider, a parent, guardian, provider, and/or other authorized person must follow applicable consent, privacy, and clinical requirements. Independent providers remain responsible for age-appropriate clinical consent and privacy obligations applicable to their services.

12. Third-Party and Provider Sites

BTN may link to provider websites, telehealth systems, payment processors, or other third-party services. Those services may have separate privacy practices and terms. BTN is not responsible for the privacy or security practices of an independent third party except to the extent required by law or contract.

13. Data Incidents and Applicable Health-Data Rules

BTN evaluates data incidents under the laws applicable to the affected information and BTN’s legal role. Depending on the circumstances, this may include state breach-notification laws, the FTC Health Breach Notification Rule, HIPAA breach-notification requirements for functions subject to HIPAA, contractual obligations, or other laws.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Effective Date” above identifies the current version. Material changes may be communicated through the website, account, email, or another appropriate method where required.
